What clients ask

A business partner owes us money. How do you proceed?

First we check the claim, the documents and the debtor: whether the debtor still exists, where its assets are and whether other creditors are ahead of you. Then we send a demand for payment, and if the debtor does not pay, we file a court claim and then apply for enforcement. We handle all communication with the debtor. We never agree a settlement, instalments or a discount without your instruction.

What does debt recovery cost?

We agree the price in advance: hourly with a cap for each stage, or a share of what is recovered. Unless agreed otherwise, the statutory lawyers’ tariff applies: Decree No. 655/2004 Coll. in Slovakia and Decree No. 177/1996 Coll. in the Czech Republic.

How long does recovery take?

It depends on whether the debtor responds, whether it disputes the claim and whether it has assets. Some matters settle after the first demand, others go through court and enforcement. We give you a time estimate once we have checked the debtor, not blindly in advance.

Will you always recover the debt?

Not always, and we tell you so at the start. If the debtor has no assets, or other creditors are ahead of you, even the best procedure will not bring the money back. That is why we check the debtor first and flag the risk of failure before costs arise.

Are small claims worth pursuing?

Often yes, especially when there are many of them. For small claims we set up the procedure and the price so that they make economic sense, for example by handling them in bulk.

Who pays the costs of recovery?

We claim the costs of recovery and late-payment interest from the debtor together with the debt, and ask the court to award costs. Whether they are actually recovered depends on whether the debtor pays.

The debtor is in another country. Can you help?

Yes. In Slovakia and the Czech Republic we represent you ourselves, before the courts of both countries. Elsewhere in the EU we use European procedures and our cooperating local lawyers.
